Welcome to the Day Three Bath & Body online store (THE "SITE"). PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS SITE. YOUR USE OF THIS SITE IS EXPRESSLY CONDITIONED UPON YOUR ACCEPTANCE OF THE FOLLOWING TERMS OF USE. BY USING THIS SITE, YOU SIGNIFY YOUR ASSENT TO THESE TERMS OF USE. IF YOU DO NOT AGREE WITH ANY PART OF THE FOLLOWING TERMS OF USE, YOU SHOULD NOT USE THIS SITE. PURPOSE OF THE SITE

The purpose of the Site is to provide you with information about DAY THREE BATH & BODY, our products and Locations, the promotions and campaigns that we support and about our company of brands.  We also utilize this SITE to share the activities we undertake. In addition, you may be able to purchase products and services through the Site.

PRODUCT AND SERVICE AVAILABILITY

Reference to any product or service on the Site does not constitute an offer to sell or supply that product or service and does not mean that the product or service is available or that the name and description of any product in your local area (locations, wholesaler, supplier or authorized brand ambassador), will be the same as that included on the Site.  Our site is controlled and operated from its headquarters in Mechanicsville, Va, in the United States of America. We in no way imply that the materials on our Site are appropriate or available for use outside of the United States and we will not be able to fill your order if you require shipping outside of the United States - unless otherwise arranged via email and invoicing. 

Inventory information is generally available on the Site for domestic (U.S.) merchandise. This information can be used to estimate the likelihood that merchandise will be shipped immediately after you place your order. However, we cannot guarantee that a product listed as "In stock" will actually ship right away, as inventory can change significantly from day to day, and is based on the natural process of soap curing, along with materials and supplies on hand. In rare cases, a product may be in stock when you place your order, and sold out by the time your order is processed. However, if an item that is marked "In stock" in your shopping cart when you place your order is sold out at the time your order is processed, we will notify you by e-mail when your order will be filled and offer you the option to cancel your order (returning your credit card charge) or shipping when item is available. You may also contact us directly, in the event our "general shipping times" have passed.

PRODUCT ORDERS

PRICES AND AVAILABILITY OF THE PRODUCTS AND SERVICES LISTED ON THE SITE ARE SUBJECT TO CHANGE WITHOUT NOTICE. The listing, description of, or reference to, a product or service on the Site does not imply that the product or service is presently available at the time of purchase. In the event a product or service is listed at an incorrect price due to a typographical error, error in pricing information received from a supplier, or any other reason, we shall have the right to refuse or cancel any order placed for such product or service at the incorrect price, even if the order has been confirmed and/or your credit card has been charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall promptly issue a credit to your credit card account in the amount of the incorrect price.

  • ORDER ACCEPTANCE

    Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason or for no reason at all. We reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any product or service.

  • SHIPPING

    In compliance with FAA regulations, we are unable to accept orders for P.O. Box addresses. We are not responsible for errors due to printing.

  • PRODUCT AND SERVICE AVAILABILITY

    Prepackaged gifts are assembled individually and may vary slightly, from pictures shown to represent items and products.  Day Three Bath & Body reserves the right to substitute a product of equal value and nature if the original product becomes unavailable.

  • PAYMENT

    You are responsible for any payments due for any products or services ordered through your account. If we do not receive payment from your credit issuer or its agents, you agree to pay all amounts due to us. You shall also be responsible for any costs of collection of overdue payment.

  • SALES TAX

    We are required by law to charge applicable sales tax on products shipped to those jurisdictions that charge such a tax and in which we operate. Currently, we sell in all fifty states.

OWNERSHIP OF MATERIALS ON THE SITE

Day Three Bath & Body and it's company of brands is, unless otherwise stated, the owner of all copyright, trademark, patent, database and other proprietary rights in the Site and its contents. Without limitation of the foregoing, we own a copyright in the Site as a collective work and/or compilation, and in the selection, co-ordination and arrangement of the information and content in the Site. You may not publish, distribute, extract, re-utilize, or reproduce any part of the Site in any material form (including photocopying or storing it in any medium by electronic means) other than in accordance with the limited use license set out in our copyright notice or as permitted by the United States Copyright Act. Except as expressly provided in these Terms of Use and the copyright notice, we grant no rights to you under any patents, copyrights, trademarks, trade secrets or any other proprietary rights.

You may not without the prior written permission of Day Three Bath & Body, AND it's company of brands use any computer code, data mining software, "robot", "bot", "spider", "scraper" or other automatic device, or program, algorithm or methodology having similar processes or functionality, or any manual process, to monitor or copy any of the web pages, data or content found on this Site or accessed through this Site. You also may not: engage in the mass downloading of files from this Site; use the computer processing power of this Site for purposes other than those permitted above; or flood this Site with electronic traffic designed to slow or stop its operation.

  2. Billing information including name, address and credit card information so that we can process payment to deliver our products or services.

  4. Information from you from our company of brands for a special offer.  In this case, we will make clear as to who is collecting the information and whose privacy policy applies. If both / all parties are retaining the information you provide, this will also be made clear as will links to all privacy policies.

Please note that the information above (“Personal Data”) that you are giving to us is voluntarily, and by you providing this information to us you are giving consent for us to use, collect and process this Personal Data. Anonymous Data Collection and Use

To maintain our Website’s high quality, we may use your IP address to help diagnose problems with our server and to administer the Website by identifying which areas of the Website are most heavily used, and to display content according to your preferences. This is essentially "traffic data" which cannot personally identify you, but is helpful to us for marketing purposes and for improving our services. We do not set any personally identifiable information in cookies, nor do we employ any data-capture mechanisms on our Website other than cookies.   2. Contract.  We will contact you under our contractual obligation to deliver goods or services you purchase from us.
  3. Legitimate Interest.  We may contact you if we feel you have a legitimate interest in hearing from us.  For example, if you sign up for a webinar, we may send you marketing emails based on the content of that webinar.  You will always have the option to opt out of any of our emails.

Process Payments

We will use the Personal Data you give to us in order to process your payment for the purchase of goods or services under a contract. We only use third party payment processors that take the utmost care in securing data and comply with the GDPR.  

Targeted Social Media Advertisements

We may use the data you provide to us to run social media advertisements and / or create look-alike audiences for advertisements. 

Share with Third Parties

We only share your information with other third parties such as our newsletter provider in order to contact you via email, our merchant accounts to process payments, and Google / social media accounts in order to run advertisements and our affiliates and company of brands.  

Viewing by Others

Note that whenever you voluntarily make your Personal Data available for viewing by others online through this Website or its content, it may be seen, collected and used by others, and therefore, we cannot be responsible for any unauthorized or improper use of the information that you voluntarily share (i.e., sharing a comment on a blog post, posting in a Facebook group that we manage, sharing details on a group coaching call, etc.).

Personal Data that you provide to us is stored internally or through a data management system. Your Personal Data will only be accessed by those who help to obtain, manage or store that information, or who have a legitimate need to know such Personal Data (i.e., our hosting provider, newsletter provider, payment processors or team members).

We have a no spam policy and provide you with the ability to opt-out of our communications by selecting the unsubscribe link at the footer of all e-mails. We have taken the necessary steps to ensure that we are compliant with the CAN-SPAM Act of 2003 by never sending out misleading information. We will not sell, rent or share your email address.

We may link to other websites on our Website. We have no responsibility or liability for the content and activities of any other individual, company or entity whose website or materials may be linked to a Website or its content, outside of our company of brands and thus we cannot be held liable for the privacy of the information on their website or that you voluntarily share with their website. Children’s Online Privacy Protection Act Compliance

We do not collect any information from anyone under 18 years of age in compliance with COPPA (Children’s Online Privacy Protection Act) and the GDPR (General Data Protection Regulation of the EU). Our Website and its content is directed to individuals who are at least 18 years old or older.
